Welcome to ProductSnap AI. These Terms of Service ("Terms") govern your use of the ProductSnap AI mobile application (the "App") operated by GazelleLabs LLC ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

ProductSnap AI is a mobile application that uses artificial intelligence to transform product photos into professional marketing images. The App allows you to:

  • Upload or capture product photos
  • Generate AI-enhanced professional product images
  • Request modifications to generated images
  • Store and manage your product image library

2. Account Registration

To use the App, you must create an account using Apple Sign-In. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent.

3. Credits and Payments

3.1 Credit System

The App uses a credit-based system. Each image generation or modification consumes credits from your balance. New users may receive complimentary credits upon registration.

3.2 In-App Purchases

You may purchase additional credits through in-app purchases via the Apple App Store. All purchases are:

  • Processed by Apple and subject to Apple's terms and conditions
  • Non-refundable except as required by applicable law or Apple's refund policies
  • Non-transferable between accounts

3.3 Pricing

We reserve the right to modify credit pricing at any time. Price changes will not affect credits already purchased.

4. Acceptable Use

You agree not to use the App to:

  • Upload content that you do not own or have the right to use
  • Generate images that are illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Create content that infringes on intellectual property rights of others
  • Generate images depicting real people without their consent
  • Create misleading, deceptive, or fraudulent content
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Circumvent any security features or usage limitations
  • Use automated systems or bots to access the App
  • Interfere with or disrupt the App's infrastructure
  • Violate any applicable laws or regulations

We reserve the right to suspend or terminate your account for violations of these terms.

5. Intellectual Property

5.1 Your Content

You retain ownership of the photos you upload to the App. By uploading content, you grant us a limited license to process, store, and display your content solely for the purpose of providing the service.

5.2 Generated Images

You own the images generated by the App using your uploaded photos. You may use generated images for personal or commercial purposes, subject to these Terms.

5.3 Our Intellectual Property

The App, including its design, features, code, and AI models, is owned by GazelleLabs LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

6. AI-Generated Content

You acknowledge that:

  • AI-generated images may not always meet your expectations
  • Results may vary based on input quality and AI model capabilities
  • We do not guarantee specific outcomes or results
  • AI technology has limitations and may occasionally produce unexpected results

You are solely responsible for reviewing and approving generated images before use.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • Results obtained from the App will be accurate or reliable
  • Any defects in the App will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAZELLELABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless GazelleLabs LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Content you upload or generate using the App

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination:

  • Your license to use the App will immediately cease
  • Unused credits may be forfeited
  • We may delete your account data

You may terminate your account at any time by contacting us at support@productsnapai.com.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or by other means. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in the United States.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GazelleLabs LLC regarding your use of the App and supersede any prior agreements.
